Executive privilege could show up both in Evidence and Constitutional Law. Note that the privilege allows the President to refuse disclosure of information, provided the matter is deemed to be of national security. All information other than that deemed to be of national security only receives a qualified privilege and disclosure will be required provided there is a showing of special need.
